Terms & Conditions

Michelle Mallon Photography (Shore Thing Creative, LLC)

These Terms & Conditions (“Terms”) outline the agreement between Michelle Mallon Photography, DBA Mich Mallon Photo operated by Shore Thing Creative, LLC (“Photographer”), and you (“Client”). By booking a session, submitting payment, or signing a contract, the Client agrees to these Terms.

1. Booking & Payment

  • A non-refundable session retainer is required to secure your date and time.

  • The session is not confirmed until the retainer is received.

  • Retainer fees cover the Photographer’s time, planning, and talent; digital files or prints are not included unless stated.

  • Remaining balances are due before the session or as indicated on the invoice.

2. Cancellation & Rescheduling

  • Retainers are non-refundable.

  • Sessions may be rescheduled based on availability; please provide at least 48 hours’ notice when possible.

  • In cases of severe weather, unsafe conditions, illness, or emergencies, the Photographer may reschedule or issue a refund.

3. Late Arrivals

  • Sessions begin at the scheduled time.

  • Late arrivals may reduce session time or the number of final images; sessions will not be extended unless at the discretion of the Photographer.

4. Image Delivery

  • Galleries are typically delivered within 7–10 days.

  • Only edited images are provided; RAW files are not available.

  • Galleries remain available for the period stated in your contract agreement.

5. Editing & Retouching

  • All images receive the Photographer’s standard editing (exposure, color correction, light retouching).

  • Extensive retouching (skin smoothing, object removal, head swaps) is available for an additional fee of $50/hr.

  • Editing style remains at the Photographer’s discretion.

6. Copyright & Usage

  • The Photographer retains copyright to all images.

  • Clients receive a personal-use license for non-commercial printing and sharing.

  • Images may not be altered, sold, or further edited without written permission.

  • Commercial use requires a separate licensing agreement.

7. Model Release

  • Unless otherwise requested, the Client grants permission for the Photographer to use images for portfolio, website, social media, marketing, and studio samples.

  • Clients may opt-out of media use with a no-share agreement before the session provided in the contract.

8. Creative Control

  • The Photographer is not responsible for clothing, hair, makeup, weather, or cooperation of subjects.

  • The Client agrees to trust the Photographer’s artistic judgment for poses, lighting, and composition.

9. Locations & Permits

  • Clients are responsible for permits or location fees unless otherwise agreed upon prior to the session.

  • Travel fees may apply for locations outside the Photographer’s standard service area.

10. Safety

  • Sessions may be stopped or canceled if safety concerns arise.

  • Children and/or pets must be supervised at all times.

11. Image Archiving

  • Images are archived for 12 months after delivery.

  • Retrieval after this period is not guaranteed.

  • Archive fees apply after this time period.

12. Liability

  • The Photographer is not liable for sessions disrupted by weather, uncooperative subjects, or late arrivals.

  • Loss or damage beyond the Photographer’s control is not the Photographer’s responsibility.

  • In rare cases of equipment failure or total loss, the Photographer’s liability is limited to a refund of payments received.

13. Agreement

This document is a summary of policies; the full photography agreement/contract will be sent separately and must be signed by both parties to finalize the booking.

By booking a session with Michelle Mallon Photography and submitting a retainer, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
